These Terms of Service govern your use of the BRS Lab Services website and any laboratory services provided by BRS Lab Services ("we," "us," or "our"), located at 45260 Indian Creek, Canton, Michigan 48187. By accessing our website or engaging our services, you agree to these terms.

1. Our Services

BRS Lab Services operates dual-licensed microbial testing laboratories in the United States and Canada. We provide laboratory testing services, environmental monitoring solutions, and white-label partner programs through our brands including Test Your World, SporeCount Agri, and AI Lab Services. All testing is performed in accordance with applicable regulatory standards.

2. Engagement of Services

By submitting samples, placing orders, or executing a service agreement with BRS Lab Services, you agree to the terms applicable to the service engaged. Service-specific terms may supplement these general terms. We reserve the right to decline any engagement at our discretion.

3. Sample Submission

You are responsible for properly collecting, packaging, and shipping samples according to our written instructions. BRS Lab Services is not liable for results affected by improper sample handling prior to receipt at our facility. Samples are retained for 30 days following report delivery and then disposed of in accordance with applicable regulations.

4. Test Results and Reporting

Test results are provided for informational and screening purposes only. Results do not constitute a medical diagnosis, regulatory compliance determination, or professional environmental assessment unless expressly stated in your service agreement. For health or safety decisions, consult a qualified healthcare provider or licensed environmental professional.

5. Payment Terms

Payment is due as specified in your service agreement or at the time of purchase. Invoices unpaid beyond 30 days may be subject to a 1.5% monthly late fee. We reserve the right to withhold reports or suspend services for overdue accounts. Prices are subject to change with reasonable notice.

6. Confidentiality

We treat all client sample data and results as confidential. Results are released only to the authorized client contact on file or as required by law. White-label partner data is kept strictly separate from other clients.

7. Intellectual Property

All content on this website, including methodologies, report formats, branding, and software, is the property of BRS Lab Services or its licensors. Test Your World™, SporeCount Agri™, and AI Lab Services™ are trademarks of BRS Lab Services. Unauthorized reproduction or use is prohibited.

8. Limitation of Liability

To the maximum extent permitted by law, BRS Lab Services' liability for any claim arising out of or relating to our services is limited to the amount paid for the specific service giving rise to the claim. We are not liable for indirect, incidental, consequential, or punitive damages.

9. Governing Law

These terms are governed by the laws of the State of Michigan. Any disputes shall be resolved in the courts of Wayne County, Michigan, and you consent to personal jurisdiction therein.

10. Changes to These Terms

We may update these Terms of Service from time to time. Continued use of our website or services after changes are posted constitutes acceptance of the revised terms.
